This is the CONDENSED version of the TOS.
Detailed info may be missing. The sole purpose of this condensed version is for the Client to have an easy overview of the main points. Workflow may differ by project. Please refer to the full TOS for detailed terms.1. Pay up front for orders below €100 EUR.2. Artwork will be delivered digitally unless otherwise agreed.3. Artist will not be responsible for loss of Artwork once it has been delivered.4. Client has right to three complete revisions in the sketching phase.5. Client has right to reasonable amounts of minor edits after completion (I.e., eye colour change)6. Payment must be in EUR, or equivalent in USD or JPY. PayPal is preferred, unless ordered through a platform requiring another method.7. Client can ask for a refund on orders with no progress for 60 days, or when work has not been completed within 120 days, unless another time period is agreed upon or required by the platform.8. Client is encouraged to contact the Artist in a fast and responsive manner.9. Works cannot be used for commercial use without additional fees and agreement.10. Artist can cancel and refund any order at any time.11. Client does not hold the right to use the Artwork in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.12. Client does not hold the right to use the Artwork in any AI-related technology, including submitting for datasets, or any future inventions in the space.

/full terms/

This contract is considered void where applicable when business is conducted on a platform with overlapping terms of service: i.e., vgen, pixiv, ko-fi.This contract applies to the artist further called ‘Artist’ and person or institution further called ‘Client’ purchasing from Artist a work of art or other creative endeavor, such as visual development or guidance, further called ‘Artwork’. By ordering Artwork from the Artist the Client agrees to the following terms and conditions:PAYMENTS
1. Client agrees to pay the due amount upfront for any orders of value lower or equal to €100 EUR. Payment must be remitted via PayPal, VGen, Pixiv or Ko-fi.
2. On orders above €100 EUR Client agrees to pay half the invoice total upfront. The other half must be paid on approval of the initial sketch.
3. Any other payment schedule must be mutually agreed before work on the Artwork commences.
4. Client accepts that work on the Artwork will not commence until payment has been received by Artist according to the above schedule.
5. Certain types of work do not allow for a split payment. In such cases Client will be informed and asked to agree to a different payment schedule before any work can commence.DELIVERY
6. Client agrees that Artwork will be delivered digitally to the discord account or email address provided by Client, after the final payment has been received by the Artist.
7. Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. Client is obliged to bear any costs incurred by alternative delivery method, such as postal costs, material costs, digital service subscription fees etc.
8. It is sole responsibility of Client to propose delivery method which works for both parties. Artist cannot be held accountable for Client's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Artist.
8b. Upon delivery of the Artwork, it is the Client's responsibility to store it properly. Loss of Artwork due to negligence will not be reimbursed by the Artist. The Artist cannot guarantee that the original copy of the Artwork will be available in the case that the Client lost their files.REVISIONS
9. If the Artwork includes a thumbnail phase, Client has the right to ten complete revisions. Otherwise, Client has the right to up three complete revisions in the sketching phase of most request types. This entails significant changes such as total redraws and composition alterations.
10. Client has right to a reasonable amount of minor edits after completion, such as changing an eye colour or fixing a small detail, up to an additional 10% of the total time spent on creating the originally delivered Artwork and in addition to fixing any mistakes. Further requests, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Any such increase will be invoiced separately. Work on any such requests will not commence until the payment for the additional invoice(s) has been received.CURRENCY CONVERSIONS
11. Client agrees to pay the total amount specified in EUR or its equivalent in USD or JPY.
12. It is the sole responsibility of Client to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Artist.
13. Payment is considered as received and completed only when total amount received on Artist's EUR/USD/JPY account is equal to the invoice amount in EUR.REFUND POLICY
14. Client has right to request a full refund if there's been no progress for two consecutive months, or when Artwork has not been completed within four months. Refund conditions for commissions which require more work must be agreed separately, before the work commences. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident or any other credibly documented reason for interruption of work.
15. Client obliges to contact the Artist in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication on behalf of Client will be recognized as implicit approval of all work progress and current state of the Artwork.PERSONAL AND COMMERCIAL USE
16. The Artwork received by Client is for personal use. Any use of the Artwork for commercial purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Artist. This will require a separate agreement between Client and Artist defining exact conditions and financial implications of such use of the Artwork, as well as a licensing fee.
17. Client may not significantly alter the Artwork without authorisation.
18. Client does not hold the right to use the Artwork in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space.
In addition, Client does not hold the right to use the Artwork for AI datasets or for AI tools and any present or future inventions in the space.CANCELLATIONS
19. Artist reserves every right to refuse or cancel any order, under condition of full or partial refund depending on amount of work completed, without giving reasons to Client.
20. Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order with full or partial refund depending on amount of work completed.

本規約（契約）と、お取引を行うプラットフォーム（ko-fi、 vgen、 pixiv等）の利用規約との間に重複または衝突する条項がある場合、プラットフォーム側の規定が優先され、該当する本規約の条項は無効とみなされます。本契約は、以下「アーティスト」と呼ぶアーティストと、アーティストから美術作品、またはビジュアル開発や指導などのその他の創作活動（以下「作品」と呼ぶ）を購入する個人または団体（以下「クライアント」と呼ぶ）に適用されます。クライアントは、アーティストに作品を注文することにより、以下の利用規約に同意するものとします。お支払い
第1条. クライアントは、注文金額が100ユーロ未満の場合、その全額を前払いすることに同意するものとします。お支払いは、PayPal、VGen、Pixiv、またはKo-fiを通じて行う必要があります。
第2条. 注文金額が100ユーロを超える場合、クライアントは請求総額の半額を前払いすることに同意するものとします。残りの半額は、初期スケッチの承認後に支払うものとします。
第3条. 上記以外の支払いスケジュールについては、作品の制作開始前に双方が合意する必要があります。
第4条. クライアントは、上記スケジュールに従いアーティストが支払いを受け取るまで、作品の制作が開始されないことを了承するものとします。
第5条. 作品の種類によっては分割払いができない場合があります。その場合は、制作開始前にクライアントにその旨を通知し、別の支払いスケジュールについて同意を求めるものとします。納品
第6条. クライアントは、アーティストが最終支払いの受領が確認された後、作品がクライアントが指定したDiscordアカウントまたはメールアドレスにデジタル形式で納品されることに同意するものとします。
第7条. デジタル形式または物理的な形式を問わず、その他の納品方法については、作業開始前に双方が合意する必要があります。クライアントは、郵便料金、材料費、デジタルサービスの利用料など、代替の納品方法によって発生するあらゆる費用を負担する義務を負います。
第8条. 双方にとって適切な納品方法を提案することは、クライアントの単独の責任です。アーティストは、クライアントが納品方法にアクセスできなくなった場合、納品されたファイルの紛失、スパムフィルターなどの障害、またはアーティストの責任範囲外のその他の技術的障害について、一切の責任を負いません。
第8条の2. 作品の納品後、それを適切に保管するのはクライアントの責任です。不注意による作品の紛失については、アーティストは補償いたしません。また、クライアントがファイルを紛失した場合、作品のオリジナル版が利用可能であることをアーティストは保証できません。修正
第9条. 作品にサムネイル段階が含まれる場合、クライアントは10回の完全な修正を依頼することができます。それ以外の場合は、クライアントはスケッチ段階で3回の完全な修正を依頼することができます。これには、全面的な描き直しや構図の変更など、大幅な変更が含まれます。
第10条. クライアントは、完成後に、目の色の変更や細部の修正など、合理的な範囲の軽微な修正を、当初の作品制作にかかった総時間の10％以内の作業量に相当する範囲で依頼することができます。これを超える依頼については、その内容がどれほど軽微であっても、事前の相互合意が必要となり、注文金額が比例して増額されます。かかる増額分は別途請求されます。このような過剰な依頼に関する作業は、追加請求書の支払いが確認されるまで開始されません。通貨換算
第11条. クライアントは、ユーロ（EUR）で指定された総額、またはそれに相当する米ドル（USD）もしくは日本円（JPY）を支払うことに同意するものとします。
第12条. アーティストへの資金送金に伴う為替変換手数料、銀行振込手数料、決済サービスプロバイダーの手数料、およびその他の費用は、すべてクライアントが負担するものとします。
第13条. 支払いは、アーティストのEUR/USD/JPY口座に入金された総額が、EUR建ての請求書金額と一致した場合にのみ、受領済みかつ完了したものとみなされます。返金ポリシー
第14条. クライアントは、2ヶ月連続で作業の進捗が見られない場合、または4ヶ月以内に作品が完成しなかった場合、全額の返金を請求することができます。より大規模な依頼作品に関する返金条件については、作業開始前に別途合意する必要があります。ただし、病気、事故、その他作業中断の正当な理由として信頼できる証拠が提示された場合など、予期せぬ事情による作業中断は、本規定の適用対象外となります。
第15条. クライアントは、アーティストからのコメント、説明、意見、進捗状況の確認などの要請に対し、迅速かつ適切に対応する義務を負います。クライアント側による適時の連絡がない場合は、作品の進捗状況および現状のすべてについて、暗黙の了承があったものとみなします。個人利用および商用利用
第16条. クライアントが受け取った作品（以下「本作品」）は、個人利用を目的としています。本作品を商用目的で使用すること、転売すること、または個人利用以外の目的で複製・公開することは、事前にアーティストの承認を得なければなりません。この場合、本作品の当該利用に関する具体的な条件および金銭的条件を定めた、クライアントとアーティスト間の別途の合意が必要となります。

第16条の2. クライアントは、本作品をNFT、暗号資産その他現在または将来のブロックチェーン関連技術において使用してはなりません。また、AI学習用データセット、AIツールその他現在または将来のAI関連技術において使用してはなりません。注文のキャンセル
第17条. アーティストは、クライアントに理由を明かすことなく、いかなる注文についても受諾を拒否またはキャンセルする権利を留保します。その場合、完了した作業の進捗状況に応じて、全額または一部の返金が行われます。
第18条. 失礼な言動は一切容認されず、注文のキャンセルにつながる場合があります。その場合、完了した作業の進捗状況に応じて、全額または一部の返金が行われます。
